1. Any use of them that includes sexual, racist, or discriminatory content may be deemed harassment, and you may be held accountable. No responsibility is taken by TEAM smswale for the information included in messages transmitted.

2.Only from 9 AM to 9 PM will promotional bulk SMS/voice call service be accessible (IST)

3.Any third-party claims resulting from communication content will not be made against TEAM SMSwaale.

4.I am aware of this and accept that promotional SMS and voice calls cannot be sent to or received at phone numbers listed in the National Customer Preference Registry of the Government of India (http://nccptrai.gov.in).

5.You warrant that all SMS/Voice material complies with laws governing intellectual property rights and fundamental human rights, and that it never violates these rights in any manner. (For instance, the right to privacy and the outlawing of discrimination on the basis of sex, race, colour, language, religion, political viewpoint, or other characteristics)

6.It is totally forbidden to utilise the SMS/Voice service for any illicit purposes.

8.You understand that TEAM SMSwaale can only influence SMS/Voice message delivery and transmission within the technological limitations placed on it since it uses major telecom carriers to transmit communications. If the recipient's phone is turned on, has free memory, and is in a service region served by the mobile network provider to whom it has enrolled, SMS/voice messages sent over the internet will be sent to the mobile network providers. You understand that sending the SMS or voice message to the recipient may not be feasible based on the recipient's mobile service provider.

9.You are in charge of maintaining the confidentiality and preservation of the user name and password. You acknowledge that all actions taken using your account are formally obligated to you.

10.TEAM SMSwaalel makes no representations or warranties regarding the performance or availability of this service, and it disclaims all responsibility for any transmission errors or failures. While team SMSwaale strives to send messages as soon as possible.

11.Because we cannot guarantee delivery of the SMS/Voice messages to recipients owing to potential faults, TEAM SMSwaale does not reimburse credits for undeliverable SMS/Voice messages to you. According to its transmission logs, TEAM SMSwaale debits sent SMS/Voice communications. With the exception of cases where an inquiry by TEAM LOGIC ERPs Pvt. Ltd. has shown evidence of a technical issue or error, these logs are considered correct and legitimate even when the client has disputed the accuracy of the accounting records.

12.You may be denied access to this service, in which case TEAM SMSwaale will refund any unused portion of your account balance. In accordance with our no refund policy, all purchases must be regarded as final.

13.The balance of the SMS/Voice account is not refundable and does not accrue interest. All SMS/Voice must be used within the validity period starting from the date of purchase, and credits cannot be carried forward unless specifically stated otherwise in a different contract.

14.You accept full responsibility for the communications sent from your account using SMSwaale services and sent in accordance with your request.

15.You are responsible for holding TEAM SMSwaale harmless and paying back any obligations, expenses, losses, and damages in the event that a third party makes a claim against TEAM SMSwaale for breach of contract.

1.You must offer a valid LONG CODE or SHORT CODE obtained from any operator within India by supplying all required legal documentation.

2.You acknowledge that I won't sell the keywords on the number given to me excessively.

3.I am aware that LONG CODE/SHORT CODE may only handle up to 40 incoming messages per minute; if the volume of traffic is higher, incoming SMS may not be processed; and Team SMSwaale is not liable for it.

4.I am aware that sending an SMS is not free and will be paid according to your SMS plan with us (not in accordance with my LONG CODE/SHORT CODE Plan).

5.I am aware that if the mobile operator rejects the LONG CODE or SHORT CODE I submit owing to any technical, non-technical, validity, or balance difficulties, I am responsible for getting in touch with the mobile operator and having the issues resolved.

6.Keywords are subjected to availability.

7.I authorize SMSwaale to host my LONG CODE/SHORT CODE Number in their datacenter.

8.You agree that Team SMSwaale is not accountable for any damages for financial or other loss arising from message delivery failure, and we are not responsible for any loss caused by message failure to reach the Long code number issued to you. Additionally, you acknowledge that the contents of messages are treated as having no value.

SERVICE VALIDITY & PRICING POLICIES

1.We are strictly abiding by the rules and regulations of TRAI.

2.Pricing may occasionally change in accordance with TRAI and Operator restrictions.

3.We will give advance notice through email and the panel for any changes to the service's pricing.

4.Amount paid for any services are non refundable.

5. The payment for any particular service can't be considered for usage of any other services. Hence the payment is non-Transferable.

6.We are offering validity in accordance with operator policy for services and credits, but we retain the right to average your remaining credits in accordance with the new pricing structure in the event of any price drop or rise from the TRAI or Operator Side.

LIMITATION OF LIABILITY

While we'll do everything we can to get your communications reach the intended recipients as soon as possible, we can't promise or guarantee a certain delivery time. These timeframes rely on a number of network and system-related elements among the many parties engaged in the delivery of your communications through cellular mobile networks.

We are unable to provide 100% availability assurances for delivery reports and the originator since they are operator dependent features. When these traits are deemed to be of great relevance, we advise conducting testing in advance.

You accept that our ability to influence the transmission of your messages is limited by the technological restrictions placed on us since we transmit and receive text messages through well-known telecommunications providers and Mobile Network Operators.

Therefore, it is our obligation to make sure that the text messages and phone calls you send via the service are properly processed and sent to the designated recipient. Since the ultimate transmission of the message is outside our control and the responsibility of the Mobile Network Operator, we are not liable.

Any SMS or voice message that cannot be delivered within the time frame allotted to it, whether by us or a mobile network operator, will be deleted by the latter without warning. You agree that Team SMSwale is not responsible for any damages for financial or other losses brought on by message delivery failure and that we are not responsible for any losses brought on by message failure. Additionally, you acknowledge that the contents of messages are treated as having no value.

You also agree that voice conversations and text messages are delivered in an unencrypted fashion and that third parties may eavesdrop on mobile phone communications, including SMS delivery. We also advise you to use a variety of communication channels to provide sensitive and important information.

Additionally, the service is provided "as is" and "as available," without any explicit or implied warranties or guarantees, and that use of the service and the Internet is at the user's own risk. We offer no warranties or guarantees that you will be able to access the service at any certain time or location, but we will use all commercially reasonable efforts to make access to the service available through the necessary access protocols. We and our affiliates, agents, content suppliers, service providers, and licensees, without limiting the breadth of the above terms.

By doing this, all express and implied warranties regarding the accuracy, fullness, legality, merchantability, and fitness for a particular purpose of the service generally, and any content or services therein, are hereby disclaimed, as well as all express and implied warranties regarding the continuity and error-free operation of the service generally and any content or services therein.

You agree to hold us harmless from any claims made by third parties that may result from any inaccuracies, errors, or omissions in, or losses, injuries, or damage caused in whole or in part by failures, delays, or interruptions of the service generally, and any element related thereto.

The terms listed above are for the benefit of Team SMSwaale and its affiliates, agents, content suppliers, and service providers, and each shall have the right to assert and enforce such rights directly on its own behalf, notwithstanding anything to the contrary included herein.

MODIFICATION OF TERMS

We continuously update, amend, and otherwise constantly work to enhance the service; as a result, these changes usually necessitate modifying the terms and conditions of use at the same time. Due to this, we reserve the right to alter this agreement's terms and, in either instance, amend or eliminate any component of our service as we see fit.Your use of the service may be discontinued in accordance with the cancellation methods outlined in this agreement if you object to any such modifications. You accept that it is your duty to periodically examine this Agreement to stay informed of any modifications, and that we will be pleased to keep you informed if/when such changes occur.

Additionally, you agree that additional special terms and conditions shall take precedence over these general terms and conditions in the event of a conflict.

TERMINATION

We reserve the right to suspend, terminate, and/or cancel this agreement if you violate the terms and conditions of the service at any time, and/or to seek damages from you related to the event(s) that led to the suspension, termination, or cancellation. We retain the right to terminate your service at any time for any reason, including if we believe it is essential to prevent any of our services from being hampered by your position as a customer, your financial situation, or the content of messages coming from you.

Any obligations that you had at the time of any such termination, cancellation, or suspension remain your responsibility. If access to or use of the service is interrupted in whole or in part due to your failure to comply with, or violation of, the terms of this agreement or any law or legal requirement, payment and other obligations under this agreement are not suspended, stayed, or otherwise impacted. You agree to stop using the service immediately upon termination and/or cancellation, regardless of the cause, and we will no longer be obligated to you following any such termination or cancellation.

This agreement is also freely revocable by you at any time and for any cause. However, in order for such a termination or cancellation to be effective, you must notify us in writing through email. After doing so, you will no longer be able to use any remaining credits in your account and will remain subject to the terms of this agreement for the time that you utilised the service.

Do not subscribe to or use the SMSwaale if you do not agree to the aforementioned "Terms of Service."
